At SANZ HERMANOS VALENCIA SLU, with Spanish tax identification number (CIF) B-46445615 (hereinafter, “GRUPO SANZ”), we are committed to offering reliable, high-quality products. Our commitment is to provide a prompt and effective response in order to minimise the impact of any incident on our customers’ operations.
These terms and conditions govern the commercial warranty granted by GRUPO SANZ to its professional customers and distributors, in accordance with our General Terms and Conditions of Sale.
1. Scope of application
These terms and conditions apply to all products marketed by GRUPO SANZ in a professional and business-to-business (B2B) context.
• Sales in Spain and the European Union: This commercial warranty is granted without prejudice to any statutory obligations relating to hidden defects that may arise under applicable law. Where the Buyer is liable to end consumers under applicable consumer law, rights of recourse between professionals shall be governed by these terms and conditions to the fullest extent permitted by applicable law.
• Outside the European Union: The warranty shall be governed by the contractual provisions agreed between the parties and, in the absence of such provisions, by these terms and conditions.
2. Warranty period
The general warranty period applicable to all GRUPO SANZ products is 1 year from the date of delivery of the goods to the professional Customer.
For products which, due to their technical characteristics, capacity or design, are designated by GRUPO SANZ for domestic or private gardening use (excluding heavy, industrial machinery or machinery intended for intensive agricultural use), and only when they are marketed by the Customer to end consumers, the period for exercising rights of recourse shall be extended to cover original non-conformities that arise within the statutory consumer period, provided that the date of sale is duly evidenced by a sales receipt or invoice issued to the end consumer.
Repairs or replacements carried out under this warranty shall not, under any circumstances, give rise to a new warranty period or extend the original period, unless otherwise required by mandatory law.
3. Warranty coverage
The warranty covers only manufacturing or material defects existing at the time of delivery, as well as malfunctions resulting from such defects.
In the event of a duly proven lack of conformity, GRUPO SANZ shall determine the most appropriate corrective measure according to the nature of the incident and the technical availability of components or products, and may proceed with:
• Repair or replacement, in whole or in part, of the product or any of its parts, as appropriate.
• Price reduction or refund of the amount actually paid by the Customer in respect of the goods concerned.
4. Warranty exclusions
The warranty does not cover, under any circumstances:
Natural wear of parts: Components subject to wear through normal use, including, without limitation: seals, filters, nozzles, valves, belts, chains, brushes, friction gears, cutting elements, transmission components and loss of battery charge capacity due to normal use (only latent manufacturing defects or defects in internal battery components being covered).
Improper use: Failure to comply with the instruction manual, use of products intended for domestic gardening in intensive agricultural applications or for continuous professional use, repair or handling by unauthorised personnel, use of non-original or non-approved spare parts, or use of unauthorised chemicals.
External factors: Impacts, drops, incorrect installation, electrical overloads, lack of maintenance or inadequate storage.
Transport: Damage arising from transport that has not been reported in accordance with Clause 6 of the General Terms and Conditions of Sale (48-hour period for apparent damage).
5. Conditions for processing a warranty claim
To process an incident under warranty, the following conditions must be met:
• The corresponding invoice or proof of purchase must be provided;
• The product’s serial number must remain legible;
• The incident must be reported in writing to GRUPO SANZ within a maximum period of 15 calendar days from the time when the defect becomes visible, and always within the general warranty period;
• The incident must be assessed and validated by an authorised Technical Assistance Service (SAT) or by GRUPO SANZ’s own SAT.
For professional customers that are not authorised by GRUPO SANZ to act as an SAT, the process shall be handled by referring the product to the official SAT nearest to their geographical area, with GRUPO SANZ providing the relevant contact details to expedite the assessment. GRUPO SANZ shall endeavour to process incidents as quickly as possible, depending on the nature of the fault, component availability and the operational workload of the relevant technical service.
Registering the product on our website is recommended to expedite any procedure, although it is not mandatory in order to exercise the applicable rights.
6. Transport costs in warranty cases
Mainland Spain: If the defect is covered by the warranty, GRUPO SANZ shall bear the standard transport costs. Otherwise, or if it is determined that the fault falls under an exclusion set out in Clause 4, GRUPO SANZ reserves the right to charge the Customer for the logistics and inspection costs.
European Union and export markets: Unless expressly agreed otherwise or provided for by the applicable Incoterms, transport costs, customs charges, duties and taxes associated with the handling of the warranty claim shall be borne by the Customer or the distributor.
7. Limitation of liability and precedence
In accordance with our General Terms and Conditions of Sale, this warranty is strictly limited to the measures described in Clause 3 of this document. GRUPO SANZ shall under no circumstances be liable for indirect damage, loss of production, damage to crops, costs arising from the interruption of agricultural work, or loss of profit resulting from equipment failure.
In the event of any discrepancy or conflict of interpretation between this Warranty Document and GRUPO SANZ’s General Terms and Conditions of Sale, the General Terms and Conditions of Sale shall always prevail.
